Sometimes, the skills of an experienced personal injury lawyer -- or at least the threat to an insurance company that such a lawyer may present -- are worth the money you must pay that lawyer to represent you. You may need a lawyer because of complex legal rules involved in your particular claim, or because the severity of your injuries might cause your compensation to vary greatly from the norm -- or simply because an insurance company refuses to settle a matter in good faith. The following types of injuries and accidents almost certainly require a lawyer's help.
Workers’ Compensation: Workers injured on the job should be able to easily obtain the benefits they are entitled to receive. Unfortunately, that is not always the case. Employers or their insurance companies may dispute the validity of the claim, the time needed for recovery before returning to work, or the degree of disability caused by the injuries. If you have been seriously injured in a workplace accident, it is in your best interests to have an experienced attorney with The Sawaya Law Firm by your side for your workers’ compensation claim.
See Automobiles – UC Vehicles for information about how you are insured when driving UC vehicles to conduct University business. As long as you are properly using a University vehicle at the time of an accident, the UC Auto Insurance Program will pay all costs except the deductible. Your department will be charged directly for the deductible. The University, through the Risk Management office and the Claims Administrator, SedgwickCMS, will deal with the other parties to the accident.
A 1985 study by K. Rumar, using British and American crash reports as data, suggested 57% of crashes were due solely to driver factors, 27% to combined roadway and driver factors, 6% to combined vehicle and driver factors, 3% solely to roadway factors, 3% to combined roadway, driver, and vehicle factors, 2% solely to vehicle factors, and 1% to combined roadway and vehicle factors.[14] Reducing the severity of injury in crashes is more important than reducing incidence and ranking incidence by broad categories of causes is misleading regarding severe injury reduction. Vehicle and road modifications are generally more effective than behavioral change efforts with the exception of certain laws such as required use of seat belts, motorcycle helmets and graduated licensing of teenagers.[15]
Arizona awards compensation for personal injury and property damage cases based on the rule of “comparative negligence.” Under comparative negligence, a jury will determine the level of fault both parties played in causing the accident. If you have filed a claim for $1,000 and it has been determined that you were 20 percent responsible for causing the accident, you would be awarded $800.
However, there are some situations where a lawsuit is necessary for recovering the compensation you need after an accident. This can include a car accident that was especially tragic and resulted in severe injury or death, or if an insurance company refuses to provide a reasonable amount of compensation that would cover the damages of a car accident.
It may sound silly to say, but the best way to prevent a painful and costly slip and fall accident while you’re out running errands is to watch where you’re going. There are so many things that can distract you: screaming kids, texting your spouse, drinking your Frappuccino, or answering one last email from your boss; do these things while you are stationary and eliminate a large chunk of the risk of slipping and falling.
In some instances, regardless of the nature of your injury or the amount of your medical bills and lost income, you will want to hire a lawyer because an insurance company or government agency simply refuses to make any fair settlement offer at all. In these cases, something -- what the lawyer can get minus the fee charged to get it -- is better than nothing.

In California, according to California Code of Civil Procedure Section 335, the statute of limitations in California is 2 years from the date of loss. A date of loss refers to the date in which the accident has happened. Minors in California who are filing a claim against an entity or person has until 2 years after their 18th birthday to satisfy the statute of limitations. For governmental claims, both minors and adults have 6 months to file a claim with its corresponding jurisdiction according to Government Code section 911.2. Auto, truck, and motorcycle accidents affect people every day. The Texas Department of Transportation keeps track of the number of crashes, fatalities, and injuries that occur on roads in our state each year. According to TxDoT, Texas saw an increase in motor vehicle traffic deaths in 2016. 3,773 people died in auto accidents in 2016. That’s a 5.45% increase from 2015. To put these traffic fatalities in perspective: one person was killed every two hours and 20 minutes.

Punitive damages are awarded to the injured plaintiff, but the real goal of these kinds of damages is to punish the defendant for its conduct -- to "hit them in the pocketbook," so to speak -- and to act as a deterrent. Since it isn't unusual for punitive damage awards to top tens of millions of dollars, most states have set some type of cap on punitive damage awards in personal injury cases.

The Stark & Stark accident attorneys will fight to recover all the benefits you deserve. However, in most cases our accident attorneys are able to obtain favorable settlements outside of the courtroom, making the experience less stressful for our clients.
Personal injury lawyers often have investigative staff at their disposal that can help with your personal injury claim. They can help recreate the accident and use the information at trial, or in negotiations with the carrier to get you the best possible settlement or verdict. Private investigators are just as important as the personal injury attorneys as they arm the personal injury lawyer with the information necessary to pursue your claim.

You may find this process frustrating, and even exasperating. However, the more information and documentation you provide to the insurance company, the more likely you are to receive fair compensation from the insurance company for all of your damages. Remember, the insurance company is not required to reach a settlement agreement with you. The insurance company may say at some point, “This is the best offer we’re going to make – if you want more money, then file a lawsuit.” (More: When Injury Settlement Talks Fail.)
(4) You may have multiple causes of action against multiple parties. If there is more than one party at fault, insurance companies often point the finger at each other in an attempt to reduce or eliminate the amount of the claim. By pursuing a personal injury lawsuit, complex issues of liability and comparative negligence can be sorted out by the court.
