The general idea behind this theory is that all landowners owe others a duty to use reasonable care to prevent injuries on their property. However, what type of duty a landowner owes to a particular person depends upon the person’s status on the property. The state of Florida recognizes three broad classes of visitors when determining the duty that a landowner owes to them:

Lack of negligence: The defendant may argue that they were not negligent in creating the condition that caused a person to trip or slip, or were not negligent in correcting the condition before injury occurred. Many different terms are commonly used to describe vehicle collisions. A 1985 US study showed that about 34% of serious crashes had contributing factors related to the roadway or its environment. Most of these crashes also involved a human factor.[14] The road or environmental factor was either noted as making a significant contribution to the circumstances of the crash, or did not allow room to recover. In these circumstances, it is frequently the driver who is blamed rather than the road; those reporting the collisions have a tendency to overlook the human factors involved, such as the subtleties of design and maintenance that a driver could fail to observe or inadequately compensate for.[50]

One of the most common defenses to a slip and fall accident is that the plaintiff was not exercising reasonable care. Under the doctrine of comparative negligence, a plaintiff's recovery is reduced by his or her percentage of fault for the accident. For example, in the example above involving a grocery store slip and fall, if there was a yellow cone that said "warning" next to the spill, but you were distracted while looking up at a sale sign and slipped anyway, you may be found partially or wholly responsible for your fall. In a state that adheres to the doctrine of contributory negligence, even if a jury finds you only 1% at fault for not noticing the spill, you cannot recover anything.
Generally, property owners and occupants owe a duty to use reasonable care to maintain any property under their control. This duty is usually owed to those on the property lawfully, such as a business' customers or social guests who have been invited. To meet the standard of care, the property owner or occupant will have to regularly check for spilled substances or uneven surfaces. In many states, this duty does not extend to trespassers.

Whether someone acted negligently will depend on what they knew. This is especially true in slip and fall cases, as the defendant's knowledge of the dangerous condition will usually be determinative. Slip and fall law refers to the liability rules governing cases in which an individual falls to the ground and suffers harm due to a dangerous condition on someone else's property. This phenomenon has been observed in risk compensation research, where the predicted reductions in collision rates have not occurred after legislative or technical changes. One study observed that the introduction of improved brakes resulted in more aggressive driving,[23] and another argued that compulsory seat belt laws have not been accompanied by a clearly attributed fall in overall fatalities.[24] Most claims of risk compensation offsetting the effects of vehicle regulation and belt use laws have been discredited by research using more refined data.[15]
In the 1990s, Hans Monderman's studies of driver behavior led him to the realization that signs and regulations had an adverse effect on a driver's ability to interact safely with other road users. Monderman developed shared space principles, rooted in the principles of the woonerven of the 1970s. He concluded that the removal of highway clutter, while allowing drivers and other road users to mingle with equal priority, could help drivers recognize environmental clues. They relied on their cognitive skills alone, reducing traffic speeds radically and resulting in lower levels of road casualties and lower levels of congestion.[25]
