Personal injury attorneys typically focus on one type of personal injury claim, such as car accident injuries or medical malpractice. They also have experience in tort law, which involves civil litigation to recover financial damages in a settlement. The following are a few scenarios where you might consider hiring a personal injury lawyer to represent you:

I was in an accident in November 2017. I was not at fault, and the other guy’s insurance company quickly got nasty in …their efforts to discourage me from seeking medical treatment for myself and my children. I finally just called The Law Offices of George Salinas. I called on a Saturday, and he called me back personally. The paralegal (Maria), and attorney assigned to my case (Eunice) both went above and beyond dealing with paperwork and nasty insurance adjusters. They helped me get the medical bills paid fairly. I would recommend them to anyone in the same situation.more »

Finally, the trial will begin and, for a typical personal injury case, last several days. At trial, the judge or jury will determine if the defendant is liable and, if so, how much the defendant is required to pay out in damages. After trial, either party can initiate an appeals process that can last from several months to several years. After the appeals process has been exhausted, a losing defendant will be required to pay the damages established at trial or on appeal.
See Automobiles – Personal Vehicles for information about how you are insured when driving personal vehicles to conduct University business. If you are using your personal vehicle to conduct University business and you are in an accident you must still report the accident to the University as described above. However, since your coverage comes from your personal automobile insurance policy, you must also contact your own automobile insurance company and advise them if someone has been injured or there has been third party property damage.
My review of Mr. Salinas is different than most since I am a legal vendor. I have been working with hundreds of attorney…s for the past 16 years. I've seen plenty of bad apples. I've personally seen George litigate cases for many years now and he knows what he is doing! From day one you will be impressed how he personally cares for your case all the way until it is resolved. Highly recommended.more »
Many personal injury lawsuits never make it to trial. It is almost always in the best interests of all parties involved to settle a personal injury lawsuit as quickly as possible to save time and resources. A settlement is also an opportunity for both parties to potentially benefit; the defendant may be willing to pay a little more than expected in exchange for a speedy resolution to the matter. Similarly, the plaintiff may be willing to forego a bit of compensation to get his or her money faster.
When the property in question is a retail business, there may be an implied invitation that customers are invited to visit the business or patronize a restaurant or hotel. The property owner or business owner has a responsibility to check for any unsafe conditions such as spills on the floor or loose railings on stairs and to provide adequate warning of the hazards if they cannot be fixed promptly.
Beware of rainwater! Georgia courts have routinely held that when people enter buildings in rainy conditions this water is tracked in the building and it is common knowledge that these areas will be hazardous. This does not mean that all falls caused by rain water accumulation are doomed to fail; rather, it just makes for a much more difficult case because a plaintiff must prove that the landowner had superior knowledge of such a hazard.

Research has shown that, across all collision types, it is less likely that seat belts were worn in collisions involving death or serious injury, rather than light injury; wearing a seat belt reduces the risk of death by about 45 percent.[52] Seat belt use is controversial, with notable critics such as Professor John Adams suggesting that their use may lead to a net increase in road casualties due to a phenomenon known as risk compensation.[53] However, actual observation of driver behaviors before and after seat belt laws does not support the risk compensation hypothesis. Several important driving behaviors were observed on the road before and after the belt use law was enforced in Newfoundland, and in Nova Scotia during the same period without a law. Belt use increased from 16 percent to 77 percent in Newfoundland and remained virtually unchanged in Nova Scotia. Four driver behaviors (speed, stopping at intersections when the control light was amber, turning left in front of oncoming traffic, and gaps in following distance) were measured at various sites before and after the law. Changes in these behaviors in Newfoundland were similar to those in Nova Scotia, except that drivers in Newfoundland drove slower on expressways after the law, contrary to the risk compensation theory.[54]
Many personal injuries involve insurance claims, and an insurance provider will generally require a release of liability before a policyholder or claimant can receive a settlement offer. Every state has different laws and regulations for handling insurance claims, but generally most policies allow for at least a few years for a claimant to dispute a claim or revisit a claim.

Punitive damages are awarded to the injured plaintiff, but the real goal of these kinds of damages is to punish the defendant for its conduct -- to "hit them in the pocketbook," so to speak -- and to act as a deterrent. Since it isn't unusual for punitive damage awards to top tens of millions of dollars, most states have set some type of cap on punitive damage awards in personal injury cases.

Take as many pictures, notes, and recordings of conversations as possible. After you’ve secured all of this, we recommend you speak to a personal injury attorney as soon as possible. First, you should get medical attention. When you get medical attention immediately after an accident, it established a track record of your injuries – which proves the injuries happened as a result of the accident.

The vast majority of personal injury cases are settled before or during trial; only a small percentage of these lawsuits are tried in court and reach a jury verdict. There are many benefits (for both the injured party and the defendant) to keeping a personal injury case out of the courtroom – and out of the hands of a jury. Read on to get a sense of how a personal injury lawyer would negotiate the settlement of a lawsuit.

Research suggests that the driver's attention is affected by distracting sounds such as conversations and operating a mobile phone while driving. Many jurisdictions now restrict or outlaw the use of some types of phone within the car. Recent research conducted by British scientists suggests that music can also have an effect; classical music is considered to be calming, yet too much could relax the driver to a condition of distraction. On the other hand, hard rock may encourage the driver to step on the acceleration pedal, thus creating a potentially dangerous situation on the road.[42]
Additionally, there may be other experts involved int the case. In car accident cases there may be a defense doctor that the defendant will use to say the injured victim did not suffer the injuries they are claiming. There also could be accident reconstruction experts, bio-mechanical experts, engineering experts, or in medical cases there will undoubtedly be several medical doctor experts.

Often mediation works, but, if it doesn’t work, the case is scheduled for trial. A personal injury trial can last a day, a week, or even longer. The length may be increased because, in many states, trials are held for only half a day instead of over a full day. That doubles the length of a trial, but also lets the lawyers and judges get other things done in the afternoon.
Truck Accidents: Large commercial trucks, fully loaded, can weigh 80,000 pounds or more, and they often cause serious injuries to passenger vehicle occupants in a collision. Large truck collision cases can be more complex than other automobile accident cases because of the number of potentially liable parties, evidence that must be preserved, and the federal regulations involved. If you have been injured or lost a loved one in a crash with large commercial truck, do not hesitate to consult with an experienced truck accident attorney with The Sawaya Law Firm.
The next thing that you will have to do for anything more than a minor claim is to choose a lawyer. You should choose the lawyer soon after the injury. You can certainly settle a small personal injury claim yourself (although a lawyer is generally useful even for smaller claims), but you will absolutely need a lawyer for any personal injury claim where you suffered significant injury or other losses.
Seek Medical Treatment. Your health—or the health of a loved one—should be your number-one priority following a slip, trip, and fall accident. If you've been hurt, it's important to see a doctor so that your injuries can be properly documented. Those medical records will be important pieces of evidence should you decide to seek compensation for your injuries.

Many personal injury claims, especially ones involving car accidents, are resolved before a lawsuit is filed. As your attorney negotiates with the insurance company representing the party who injured you, a monetary offer may be presented to your attorney to settle the case. If a settlement offer is made, your attorney will inform you about the offer and give his or her opinion on whether you should accept it. You ultimately decide if the settlement is acceptable. In the increasingly chemical world, we sometimes become ill because of exposure to contaminants in the air, soil, or water, in products, or in food. Claims based on such exposure are difficult to prove, however, and often require complex scientific data. And because the chemical and other industries have erected a huge wall to protect themselves from legal exposure while they continue to expose us to potentially harmful chemicals, the required evidence is very hard to come by. Get expert help.
Aside from insurance claims, auto accident victims also might be legally entitled to financial compensation from liable parties. A skilled lawyer can help you assess whether or not you have a case and can represent you if you decide to pursue a personal injury lawsuit. The person or organization responsible for your injury will most likely avoid paying you unless they are legally compelled by the courts. Working with an auto accident attorney can even convince the responsible party to settle out of court, paying you sooner and with less hassle.
In 2013, 54 million people worldwide sustained injuries from traffic collisions.[1] This resulted in 1.4 million deaths in 2013, up from 1.1 million deaths in 1990.[2] About 68,000 of these occurred in children less than five years old.[2] Almost all high-income countries have decreasing death rates, while the majority of low-income countries have increasing death rates due to traffic collisions. Middle-income countries have the highest rate with 20 deaths per 100,000 inhabitants, accounting for 80% of all road fatalities with 52% of all vehicles. While the death rate in Africa is the highest (24.1 per 100,000 inhabitants), the lowest rate is to be found in Europe (10.3 per 100,000 inhabitants).[3]
The World Health Organization, a specialized agency of the United Nations Organization, in its Global Status Report on Road Safety 2009, estimates that over 90% of the world’s fatalities on the roads occur in low-income and middle-income countries, which have only 48% of the world’s registered vehicles, and predicts road traffic injuries will rise to become the fifth leading cause of death by 2030[74]
Unlike other lawyers, personal injury lawyers don’t charge an hourly rate. Instead, they accept a percentage of their client’s compensation for punitive damages as payment. In high profile cases, personal injury lawyers may earn as much as 40% of their winning client’s compensation. Payment is made on a contingency basis meaning the plaintiff only pays if the lawyer recovers money on his behalf.
