Truck Accidents: Large commercial trucks, fully loaded, can weigh 80,000 pounds or more, and they often cause serious injuries to passenger vehicle occupants in a collision. Large truck collision cases can be more complex than other automobile accident cases because of the number of potentially liable parties, evidence that must be preserved, and the federal regulations involved. If you have been injured or lost a loved one in a crash with large commercial truck, do not hesitate to consult with an experienced truck accident attorney with The Sawaya Law Firm.
In some countries, those prevailing in trial may recover their attorneys' fees from the opposing party. In the United States A party may be able to seek sanctions when the other party acts without legal basis or justifiable cause. For example, if the opposing party continues to object to the complaint without significant reason or justifiable cause, a party may apply a motion for punitive damages or that the opposing party is harassing and or speculating without merit or reason.
Inadequate Security — A premises liability claim based on inadequate security may be appropriate if a guest or patron has been assaulted or robbed because a property owner failed to take safety measures to make a property safe such as replacing defective windows or doors, hiring adequate security personnel or replacing burned out lights. It must be proved that the property owner or business had a duty to provide for the safety of the person who suffered injury. Our attorneys investigate to determine if similar violent crimes have occurred recently at or near the property, therefore underscoring the need for added security.
In some cases, a personal injury law firm may also have medical personnel on staff that can evaluate your claim and tell you what type of personal injury claim you have and also interpret the medical records that they receive from your physicians and serve as a buffer between you and the physicians. They will also be able to make sure that you are receiving the best personal care for your injuries and best serve your personal injury case by being thorough and professional.

In the pre-trial process, both sides will ask each other for evidence and witness information in a phase called “discovery.” At the early stages, both sides will also appear in court to inform the judge of how the case is proceeding, to agree or not agree to mediation or arbitration, and to set a trial date. As the discovery process proceeds, both sides will begin to schedule  depositions  of the opposing party and witnesses, i.e. examinations and cross-examinations under oath outside the courtroom.
Arbitration is an alternative to the trial process. Arbitration is similar to a trial, but is conducted before an arbitrator or a panel of arbitrators. In binding arbitration the decision of the arbitrator or panel is as final as the trial court’s verdict. Parties to a lawsuit can agree to enter arbitration and are required to submit to arbitration in some contracts. For example, if you sign a contract with a health care provider that has an arbitration clause, if that person injures you, you may be bound by the agreement to use arbitration. Arbitration is usually less expensive than litigation and may be quicker.
After you have received the necessary medical treatment, it is best to start looking into your legal options. Litigation is a recourse for people who were injured through no fault of their own. If you didn’t cause your accident, you shouldn’t have to foot the bill for your medical expenses, time off work, and otherwise. Evidence can become more difficult to track down with each passing minute, so start this process as soon as you can.
Three plus years ago my husband and I were involved in a very serious car accident that changed our life as we known it …. We were both injured as a result of the accident and I known that I needed to find a very special person not only an attorney but a good person who would help us during this most difficult times . I prayed to Our Heavly Father to give me a sign and to direct us to a good person a special attorney we could trust to have our well being at heart. I looked on the interest and 4 different times George's name and picture kept popping up. I told the Lord , yes I get it this is the best person and you have sent him to us. I called the phone number and left a message. Not very long after that I got a call not from his staff but by George himself. During these past 3 plus years , George, Amanda and Carol were truly a God sent my husband and I always left that they really cared about us on a personal base, and we're always there, just a phone call away. Thank you so much for the all you George, Amanda and Carol have done for us. We feel that they will always be an extended family, as they live in our hearts. Thank you , Gume and Maggie Gonzales, more »
It is important to get names, address, and phone numbers of everyone involved in the accident. A description of the car and license plate number can also be helpful, but make sure you also get their insurance company and the vehicle identification number of their car. Don't just assume the license plate number will do because most insurance companies only record the type of car and the vehicle identification number, not the license plate number. There is a complete list of how to collect this information for you in the 5 sections below.

A number of factors contribute to the risk of collision, including vehicle design, speed of operation, road design, road environment, and driver skill, impairment due to alcohol or drugs, and behavior, notably speeding and street racing. Worldwide, motor vehicle collisions lead to death and disability as well as financial costs to both society and the individuals involved.

A date of loss refers to the date in which the accident has happened. Emotional distress. Usually linked to more serious accidents, emotional distress damages are meant to compensate a personal injury plaintiff for the psychological impact of an injury -- including fear, anxiety, and sleep loss. Some states consider emotional distress as part of any "pain and suffering" damage that is awarded to a personal injury plaintiff.
Decide whether to accept the insurance settlement or file a personal injury lawsuit. There are things to consider when deciding whether to file a lawsuit or accept the insurance settlement. Although it make take longer to obtain financial recovery in a personal injury lawsuit, there are several reasons why you may want to do so, including the following:

We thoroughly research the nature of your injuries and team with you and your doctor's to get you back to a state of vibrant health. We communicate with you every step of the way. We encourage you to try different practices to reduce stress in your life. Stress and pain are inextricably related and over the years we've found many things that can help relieve stress. We'll encourage you to try them as we go forward with you on your road to recovery.

A personal injury is different than property damage. If you were involved in a minor fender bender that caused only minimal damage to your vehicle and you suffered no injuries to your body or psyche, you have not suffered a personal injury. In this scenario, an insurance company or a small claims court may provide you with a remedy. However, you do not have a legally recognized basis for a personal injury lawsuit.

"I have never actually needed a lawyer before until I had my first car accident which was caused by someone else. My dad researched lawyers in our area and Ed had top-rated reviews, so naturally, we chose him. They helped me obtain medical treatment right away and always checked up on how I was doing. They were always very friendly, answered all my questions, and kept me informed. A very pleasant experience.. got a great settlement. The rest of the staff great as well, very friendly and inviting. I always felt welcomed any time I needed to stop by the office to sign paperwork. I would highly recommend this law office." - Kristina M.

Your case may settle outside of court or may be resolved in a court of law by a judge or jury. You could also potentially take action not just against those who own the property, but also against tenants or renters who were in control of the space and who allowed unsafe conditions that led to a slip and fall. Our team can help you examine all your options and work to help you receive the full compensation to which you are entitled.
The reason this is an important category of car accident claims is because soft tissue injuries often aren’t visible.  For example, a sprained wrist might hurt so bad you literally can’t sleep—but on the outside, there’s not even bruising.  This is important because juries tend to have more sympathy, and award higher amounts, if an injury looks bad.  Insurance companies know this and will try to offer you less money.
Unless your injuries were very minor (i.e. very minor soft tissue injury from a 5 MPH fender bender), you should consult with an attorney very soon after your accident. A good personal injury attorney can help you gather key evidence and provide valuable advice on how to document your injuries and damages. Under no circumstances should you talk to an attorney representing the other person in the accident, the other person’s insurance company representative, or sign any documents, before consulting with your own attorney first.
One important thing to know about trials is that just because a lawsuit is scheduled for trial does not mean that the trial will actually occur on that date. Trials often get rescheduled because of the judge’s schedules. If your trial gets cancelled, you should not automatically assume that the lawyers are conspiring against you or that something unfavorable is happening. Trials are delayed all the time, and for the most innocuous of reasons.
Some non-economical damages such as pain and suffering attributed to the damages, like for example having anxiety after a car accident, may be attributed to general damages that can be proved in court and may be entitled to monetary means of compensation. There are other torts, both intentional and non-intentional, that may be pursued and or mixed with personal injury.
Special considerations arise when a slip and fall accident takes place on public property. Foremost is the issue of sovereign immunity. Historically, individuals were completely barred from suing the government for negligence. In modern times this rule has been amended by statute, and the government now allows itself to be sued in limited circumstances. If an injury does qualify, victims must also comply with strict notice requirements and time limits.
In the UK, research has shown that investment in a safe road infrastructure program could yield a ⅓ reduction in road deaths, saving as much as £6 billion per year.[51] A consortium of 13 major road safety stakeholders have formed the Campaign for Safe Road Design, which is calling on the UK Government to make safe road design a national transport priority.
In the United States, individuals involved in motor vehicle collisions may be held financially liable for the consequences of a collision, including property damage, and injuries to passengers and drivers.[95] Where another driver's vehicle is damaged as the result of an accident, some states allow the owner of the vehicle to recover both the cost of repair for the diminished value of the vehicle from the at-fault driver.[99] Because the financial liability that results from causing an accident is so high, most U.S. states require drivers to carry liability insurance to cover these potential costs. In the event of serious injuries or fatalities, it is possible for injured persons to seek compensation in excess of the at-fault driver's insurance coverage.[100]
Medical Malpractice: Healthcare providers are people, and make mistakes like everyone else. If a doctor, or nurses, mistake has harmed you – we can help correct that injustice. We can help you – by conducting an investigation into their conduct, and trying to determine how/when they deviated from an expected standard of care. We can build a case, in order to can you compensation. Often, these mistakes can follow you for the rest of your life.
See Automobiles – Rental Vehicles for information about how you are insured when driving rental vehicles to conduct University business. If you are using a rental vehicle to conduct University business and you are in an accident you must still report the accident to the University as described above. However, your insurance coverage comes from the rental car company so you need to report the accident to the rental car company as well and advise them if someone has been injured in the accident, if there has been third party property damage, or if the rental vehicle has been damaged.

We can then seek just compensation for your medical expenses, lost wages, pain and suffering and other damages by dealing directly with the insurance companies on your behalf. We can seek a financial recovery for you through the at-fault driver’s liability coverage and, if necessary, turn to your own uninsured/underinsured motorist (UM / UIM) coverage.
Criminal prosecution: More severe driving misconduct, including impaired driving, may result in criminal charges against the driver. In the event of a fatality, a charge of vehicular homicide is occasionally prosecuted, especially in cases involving alcohol.[96] Convictions for alcohol offenses may result in the revocation or long term suspension of the driver's license, and sometimes jail time, mandatory drug or alcohol rehabilitation, or both.[97]

Most personal injury damages are classified as "compensatory," meaning that they are intended to compensate the injured plaintiff for what was lost due to the accident or injury. A compensatory damages award is meant to make the injured plaintiff "whole" again from a monetary standpoint (to the extent that's possible). This means trying to put a dollar figure on all the consequences of an accident. Some compensatory damages are relatively easy to quantify -- like reimbursement for property damage and medical bills. But it's harder to place a monetary value on pain and suffering or the inability to enjoy hobbies because of physical limitations caused by lingering accident-related injuries.

Having the right personal injury attorney on your side can mean the difference between winning and losing your case, so choose yours carefully. Ask the attorney about his or her level of expertise and track record handling your type of case, their policy regarding communicating with clients, and any other questions you might have. At the initial meeting, the attorney will ask you many questions in order to get a full understanding of your case. Be wary of any attorney who, during the initial meeting, makes promises about how much money you can expect to receive. Good lawyers need more time to truly evaluate the value of your case, and they sometimes need to get experts involved too.
The further along in the process you go, the more likely it is that you’ll pay your lawyer more. This is because each stage in the process requires more work on the part of your lawyer. Do your part to read related articles, talk to your attorney, and learn about the different pricing options that exist. Remember that a local personal injury attorney may have a different price than what you see online.
The lawsuit process is complex, with many twists and turns, each requiring expert decision-making skills on the part of an attorney. Be sure your personal injury attorney has expertise in cases like yours and a proven track record of success. And since your lawsuit may last for months to years, make sure you have a good rapport with your attorney. Remember, you have only one opportunity to get the compensation you deserve for your injuries or loss, and having the right attorney on your side can mean the difference between winning and losing your lawsuit. Choose yours wisely.
