The amount and kind of damages you may be entitled to depend on the facts of your case. In Florida, there are two different types of damages: economic damages and non-economic damages. Economic damages consist of past and future medical care costs and past and future lost wages. Non-economic damages consist of past and future pain, suffering, mental anguish, loss for the capacity to enjoy life and inconvenience.

Your insurance agent or the person who you speak to at your insurance company claims phone number,  will be able to walk you through how to file your claim after an accident. If your insurance company has an app, you may also have the option to start the claims process there or visit your insurance company website to see if you can fill in the information or follow up on your claim online.

Usually party depositions and lay witness depositions can be completed within a few months of the first phase of written discovery being completed. Expert and medical depositions take a little longer due to scheduling issues and oftentimes many of the expert depositions are not needed until the case gets close to trial. Expert and medical depositions can get very expensive, therefore, we generally recommend holding off on these depositions in an effort to control case costs. This is a strategy that is discussed with the client and a final decision is then made.
Generally, property owners and occupants owe a duty to use reasonable care to maintain any property under their control. This duty is usually owed to those on the property lawfully, such as a business' customers or social guests who have been invited. To meet the standard of care, the property owner or occupant will have to regularly check for spilled substances or uneven surfaces. In many states, this duty does not extend to trespassers.
Ultimately, your attorney is in the best position to let you know when a settlement offer is fair, or when your case is strong and you should go to trial. Make sure you consult with a qualified lawyer before giving up your right to sue or accepting or turning down a settlement, as once you make a decision on accepting a settlement, you cannot simply change your mind later on.
Motor vehicle accidents including car accidents, motorcycle accidents and truck accidents are the most common type of personal injury claim. These claims are typically based on the theory of negligence. In most Illinois motor vehicle accidents, the injured party, the plaintiff, must establish the negligence the defendant in order to seek civil damages. Furthermore, the plaintiff must show that the defendant’s negligence was the proximate cause of both the accident and the plaintiff’s injuries. A chicago car accident attorney can help guide you through this process.

That’s not all, though. They will use all of that information to go head-to-head with the defendant’s attorneys to get you the best compensation possible. Oftentimes this happens in a settlement meeting, but if the big corporation or insurance company won’t budge, our attorneys are trained, experienced, and ready to go to court. (Whether in a settlement or at court, we’ve been able to win compensation many times over the defense’s initial low-ball offers.)
A property owner (or their employee) should have recognized a dangerous  condition (i.e. a  pothole  or an uneven walking surface)  and removed or repaired  the potential danger, but did not.  The key question here is whether  a reasonable person would have identified the condition as hazardous, and whether the defendant had ample opportunity to remedy the situation before the accident occurred. Most people assume auto accidents are the driver’s responsibility – assuming a drunk, reckless, or distracted driver caused the accident. Maybe they swerved into oncoming traffic or failed to brake at a stop light, rear-ending another vehicle. Our auto accident attorneys can assess driver behavior and investigate whether another individual directly caused or contributed to your crash.

Thus, an easy way to think about landowner liability for slip and fall accidents is to split it into two tracks: liability for people who were invited onto the property and liability for people who were not invited onto the property. Landowners owe people who were invited onto the property (invitees and invited licensees) the duty to prevent slips and falls. For people who were not invited onto the property (uninvited licensees and trespassers), landowners owe no such duty.
Automobiles are a part of everyone’s daily life whether you are a vehicle owner, a passenger, or a pedestrian. Practically everyone has been the victim of a car accident or has known someone close who has been. When an auto accident occurs, an extensive network of personnel immediately becomes involved in the victim’s life. This network could include law enforcement, rescue personnel, hospital staff, towing companies, salvage yards, repair shops, doctor’s offices, investigators, and of course insurance companies. With so many moving parts, it is often difficult to make decisions or even know what you are being asked to decide.
Sometimes your case is not over even if a jury gave a verdict in your favor. The defense could appeal the case and ask a higher (appellate) court to reconsider the verdict. If an appeal is not brought, it can still take some time to distribute the monetary award. Before you get paid, your lawyer is required to first pay any companies that have a legal claim to some of the money, known as a lien, out of a special escrow account. After that, your attorney simply writes you a check and the money is yours to keep. Your personal injury lawsuit is now over.
After a car crash or traffic collision, you are vulnerable for several reasons. Dealing with insurance companies can be tricky, stressful, and even risky. They are businesses, first and foremost, so your well-being is not a priority. Insurance companies have been known to illegally deny, delay, or reduce claims, and a lawyer can protect you and help you with the complicated filing procedure.

“Slip and fall” accidents usually involve a scenario where a person is injured by slipping or tripping and falling due to a dangerous hazard on an owner’s premises. Falls can of course occur inside and outside, and are most often caused by wet floors, but can also be caused by poor lighting near uneven stairs or steps, uneven or broken flooring, weather-related hazards such as snow or ice, especially black ice, or by other non-obvious hazards.
Although some jurisdictions have historically helped people obtain affordable legal representation, those systems have typically been narrowed and may exclude personal injury cases. For example, in England legal aid from the government was largely abolished in the late 1990s and replaced with arrangements whereby the client would be charged no fee if her or his case was unsuccessful.[8]
Licensees: There are two types of licensees: invited and uninvited. An invited licensee is someone who is invited to come onto the property by the landowner as asocial guest, while an uninvited licensee is someone who is not invited to enter the land, but whose presence there is reasonable under the circumstances, such as a door-to-door salesman or mailman.

Unless your injuries were very minor (i.e. very minor soft tissue injury from a 5 MPH fender bender), you should consult with an attorney very soon after your accident. A good personal injury attorney can help you gather key evidence and provide valuable advice on how to document your injuries and damages. Under no circumstances should you talk to an attorney representing the other person in the accident, the other person’s insurance company representative, or sign any documents, before consulting with your own attorney first.

In gathering sufficient evidence that accurately represents your condition, you are providing information the court (or even an insurance adjuster) could use to estimate how much money you should get for pain and suffering. In court there generally isn’t a single, standard calculation used to assess a dollar amount on pain and suffering, although you will read about a “multiplier” calculation around the internet. Essentially, a jury could award compensation for pain and suffering based on fairly subjective factors, such as the credibility of the plaintiff’s testimony and whether they even like the plaintiff. Having records and related evidence can help bolster your case for pain and suffering compensation in the face of these subjective factors.
The amount of your accident compensation is mostly determined by how severe your injuries were. And the severity of your injuries is measured by the amount of your medical bills, the type of injuries you have, and the length of time it takes for you to recover. As the amount of your potential compensation increases, the range within which that compensation may fall becomes wider. In such cases, it may be worth the expense to have a lawyer handle your claim and make sure you receive compensation at the highest end of the range.

Most cases settle before trial. At  any  point in the process described above, the parties can settle and end the case. In fact, the plaintiff can send the  first settlement offer  before the complaint is ever filed. What is more typical, particularly if the initial evidence establishing liability and/or damages is inconclusive, is that a settlement is reached after the discovery process has gone on for a while.
Three plus years ago my husband and I were involved in a very serious car accident that changed our life as we known it …. We were both injured as a result of the accident and I known that I needed to find a very special person not only an attorney but a good person who would help us during this most difficult times . I prayed to Our Heavly Father to give me a sign and to direct us to a good person a special attorney we could trust to have our well being at heart. I looked on the interest and 4 different times George's name and picture kept popping up. I told the Lord , yes I get it this is the best person and you have sent him to us. I called the phone number and left a message. Not very long after that I got a call not from his staff but by George himself. During these past 3 plus years , George, Amanda and Carol were truly a God sent my husband and I always left that they really cared about us on a personal base, and we're always there, just a phone call away. Thank you so much for the all you George, Amanda and Carol have done for us. We feel that they will always be an extended family, as they live in our hearts. Thank you , Gume and Maggie Gonzales, more »
If you are considering taking an injury claim to trial, you may already have been told by a lawyer, friend, or your insurance company that taking your case to trial increases your chances of receiving a higher dollar value through a jury award. Going to trial may also give you a better chance of recouping all of your out of pocket costs.   As such, the option of taking a personal injury case to trial as opposed to settling can sometimes be beneficial to you from a financial perspective, but there are risks and rewards to taking a personal injury case to trial that you should be aware of before you decline a settlement offer and decide to go the trial route.
In insurance, "personal injury," as typically defined, does not include mental injury that occurs as a result of defamation, false arrest or imprisonment, or malicious prosecution. For example, the Insurance Services Office standard general liability form has a section providing this coverage.[19] Some home insurance policies include personal injury coverage.[20]
(1) You may get additional compensation in a personal injury lawsuit. Insurance companies are limited by the amount of coverage that the insurance policy provides, but in a personal injury damages award is not necessarily limited to the limits of the insurance policy and you may be able to recover additional sums from the negligent driver, especially if he or she has significant assets.
Many people who are involved in an automobile accident delay seeking medical care or treatment because they don’t have medical insurance. When you come to Accident Care and Treatment Center, Inc., you never have to worry about that. We don’t require you to have medical insurance, which means you can get the care you need even if you don’t have current coverage. This is possible, in part, because we deal with the liable party’s automobile insurance company to make sure that you get the care you need.

You would file a personal injury lawsuit in this instance to pursue compensation for immediate medical bills that stem from the crash and future medical expenses, such as rehabilitation. There are also damages available for lost wages, because of an inability to work and the lost ability to work in the future, along with compensation for the physical and emotional suffering you’ve endured.

One good way to find a lawyer is to ask friends, acquaintances, or other lawyers for referrals -- and then interview the candidates. In addition, Nolo provides a personalized Lawyer Directory with information about each lawyer's experience, education, and fees, and perhaps most importantly, the lawyer's general philosophy of practicing law. By using Nolo's directory you can narrow down candidates before calling them for a phone or face-to-face interview. For more details on locating and selecting a good personal injury lawyer, read Nolo's article on Finding a Personal Injury Lawyer.
After the complaint is filed, the plaintiff’s attorney will have a month or more to locate the defendant and “serve” the complaint on him or her. Serving the complaint basically means physically delivering the complaint to the defendant in a way that can be proved later, ensuring the defendant cannot later claim to not know about the lawsuit. Along with the complaint, the service papers will tell the defendant the next date he or she must appear in court.
